Supreme Court agrees to hear NLRB challenge The U.S. Supreme Court agreed Monday to hear the U.S. Chamber of Commerce's challenge to what it says were unconstitutional recess appointments to the National Labor Relations Board by President Barack Obama. In January, the U.S. Court of Appeals for the D.C. Circuit invalidated an NLRB decision against the Noel Canning Corp., holding that the board lacked a quorum because the three "recess" appointments to the five-member board were unconstitutional, according to the Chamber.
